Update, October 2026: the earned settlement proposals are still not law. On 15 September 2026 the Home Secretary told MPs the final policy will be set out later this year. Read the latest position and what to do if you are close to five years.
Key Takeaways
- No 10-Year Rule Yet: The proposed "Earned Settlement" extension from 5 to 10 years was not part of the March 2026 rule changes; the 5-year route remains for now.
- B2 English Level Confirmed: For settlement applications made on or after 26 March 2027, the English requirement rises to B2 on most work, family and long residence routes. The change is to settlement, not to work visa applications.
- Skill Requirements: For settlement, the Immigration Rules require B2 in Speaking and Listening. The Home Office caseworker guidance says all four skills, which goes further than the Rules. A new Skilled Worker visa has required B2 in all four skills (Reading, Writing, Speaking, Listening) since 8 January 2026.
- No Start Date Set: The settlement duration proposals are still proposals, and the 5-year route applies until new rules are laid before Parliament and come into force.
- Verification Provider Update: Since 26 March 2026, the rules refer to the "qualification and language assessments provider" instead of naming Ecctis.
- Transition Period: B2 applies only to settlement applications made on or after 26 March 2027. A Skilled Worker who applies before that date has no English requirement at the settlement stage, and a partner or adult child needs B1 in speaking and listening.
Introduction
The UK Home Office published a comprehensive Statement of Changes in Immigration Rules (HC 1691) on 5 March 2026. While these documents cover a vast array of technical updates, one of the most significant shifts for visa applicants and sponsors involves the English language proficiency requirements.
At the same time, there has been widespread discussion about another possible reform known as “Earned Settlement.” This proposal would extend the settlement route from five years to ten years.
However, it is important to clarify that the 10 year settlement rule has not yet been introduced. The government has not finalised this proposal, and no start date has been set. Our earned settlement update has the latest position. For now, the five year settlement route remains unchanged.
For the full settlement rules, including the qualifying period and the English requirement, see our guide to indefinite leave to remain and settlement.
What has been officially confirmed is the increase in English language requirements, which will take effect in 2027.
For many years, the CEFR B1 level was the standard benchmark for settlement and specific work routes. However, the new rules introduce a phased increase in difficulty, shifting the requirement to CEFR B2 for several key categories.
These changes will affect several immigration routes including:
- Skilled Worker visa
- Global Talent visa
- Innovator Founder visa
- Scale-up Worker visa
- UK Ancestry visa
- Representative of an Overseas Business route
- Long Residence settlement
- Family settlement routes
- Private Life applications
For applicants and employers, understanding when the new requirement takes effect and who it affects is essential.
This blog explains the 2026 English language rule changes in simple terms, including the timeline, affected visas, and what applicants should do next.
The Core Change: From B1 to B2 Proficiency
The primary update across various appendices (including Skilled Worker, Global Talent, and Settlement) is the elevation of the required English language level.
It is vital to distinguish between the different requirements for work visas versus settlement. The number of "skills" (speaking, listening, reading, and writing) you need to prove depends on your application type.
English Requirement Summary Table
| Application Type | Skills Required | Level (Before 26 Mar 2027) | Level (On or After 26 Mar 2027) |
| Settlement (ILR) | Speaking & Listening | B1 for partners and adult children. No English requirement at settlement for a Skilled Worker main applicant | B2 |
| Skilled Worker (Initial) | Speaking, Listening, Reading & Writing | B2* | B2 |
Note: For Skilled Worker, Scale-up, and HPI routes, the requirement for all four skills at B2 took effect on 8 January 2026 for new applicants.
To give you a better idea of the difficulty jump, here is how the new B2 requirement compares to standard IELTS band scores:
CEFR vs. IELTS Band Score Comparison
| CEFR Level | Level Description | Equivalent IELTS Band Score |
| B2 | Upper Intermediate | 5.5 – 6.5 |
| B1 | Intermediate | 4.0 – 5.0 |
| A2 | Elementary | 3.0 – 3.5 |
| A1 | Beginner | 1.0 – 2.5 |
Which Visa Routes are Affected?
The Home Office has integrated these changes into almost every major immigration category. If you are planning to apply for indefinite leave to remain (settlement) or specific high-value work visas, these updates apply to you.
1. Skilled Worker Route (Appendix SW)
For settlement as a Skilled Worker, the immigration rules now confirm that applicants must demonstrate B2 English speaking and listening for applications made on or after 26 March 2027. The caseworker guidance says all four skills, and our guide to B2 English for Skilled Worker ILR explains the difference.
2. Global Talent and Scale-up (Appendix GT & SCU)
Global Talent and Scale up visa holders will also need to meet the B2 English standard when applying for settlement.
These routes are designed for highly skilled individuals contributing to the UK economy, and the government wants stronger language integration.
3. Family and Private Life (Appendix SF & PL)
Settlement applications under family or long residence routes are also affected.
This includes:
- Family settlement routes
- Private Life applications
- Long Residence applications
Applicants in these categories should prepare for the B2 transition before the 2027 deadline.
4. Other Affected Routes
- Minister of Religion (Appendix MOR)
- Representative of an Overseas Business (Appendix ROB)
- Innovator Founder (Appendix INNF)
- International Sportsperson (Appendix ISP)
- UK Ancestry route
On the Innovator Founder and T2 Minister of Religion routes, the settlement English requirement applies to partners and adult children. Those appendices set no English requirement for the main applicant at settlement.
Technical Updates: Ecctis Is Now the "Qualification and Language Assessments Provider"
Another subtle but important change involves how qualifications are verified. The Home Office is moving away from specifically naming "Ecctis" in the rules.
Instead, the rules now refer to the "qualification and language assessments provider." This change (found in INTRO2 and INTRO3) signals a move toward a contracted supplier model for comparing overseas degrees and English proficiency. While the service remains effectively the same for the user, your documentation must now align with this new "Qualification and Language Assessments Provider" framework.
Exemptions and "Efforts to Learn"
The Home Office still provides a safety net for those who genuinely struggle to reach the required level despite significant effort.
Under paragraph EL 1.1 of Appendix English Language, an applicant aged 65 or over, aged under 18, or with a disability that prevents them from meeting the requirement is exempt. A further exemption covers a partner, parent or dependent child aged over 18 who has spent a continuous period of 15 years in the UK with permission and holds a speaking and listening qualification at level A2, if:
- They provide confirmation from a qualified teacher that they have attended at least 75 guided learning hours in the 12 months before the application.
- The teacher confirms that the applicant is unlikely to reach the required level (B1 or B2, depending on the date) through further study.
Summary of Implementation Dates
It is vital to distinguish between when the rules were published and when the higher standards actually kick in.
- 26 March 2026: Most technical phrasing changes and the new "assessment provider" terminology take effect.
- 26 March 2027: The "Hard Deadline". Settlement applications made on or after this date need B2 on the affected routes.
What About the 10 Year “Earned Settlement” Proposal?
Many migrants are currently concerned about the possibility of the settlement route increasing from five years to ten years.
At the moment, this change has not been implemented.
The proposal remains under consideration, and no start date has been set.
For now, the five year settlement pathway remains in place.
This means migrants who qualify for settlement should focus on planning their application timeline, especially if they wish to apply before the B2 English requirement takes effect.
Conclusion
The 2026 Statement of Changes in Immigration Rules introduces an important update to English language requirements for many UK visa and settlement routes.
The key change is that the requirement will increase from B1 to B2 level for settlement applications made on or after 26 March 2027.
At the same time, the proposed 10 year “Earned Settlement” rule has not yet been introduced, meaning the current five year route remains unchanged for now.
Migrants planning their future in the UK should review their immigration timeline carefully. A Skilled Worker who applies for settlement before that date has no English requirement at that stage, and a partner or adult child needs B1 in speaking and listening.
Preparing early will help avoid delays and ensure compliance with the upcoming rules.
