What changed: Corrected the English requirement at settlement (B2 in speaking and listening for Skilled Worker applications made on or after 26 March 2027), added that days between the visa start date and arrival count as absences, and updated the absence exceptions, the salary rules and the timing of the settlement proposals.

Key Takeaways

  • The 5-Year Route is Still Active: Despite discussions about a 10-year "Earned Settlement" model, the 5-year qualifying period remains the law for Skilled Workers until new rules are laid before Parliament and come into force.
  • Clock Starts on Your Visa Start Date: If your visa was granted overseas, your 5-year qualifying period begins on the start date shown on your visa or eVisa, not the date you landed in the UK. The days between that start date and your arrival also count as days outside the UK.
  • The 180-Day Absence Limit: You must not exceed 180 days outside the UK in any 12-month period, and only the reasons listed in the Immigration Rules are left out of the count, such as a life-threatening illness or travel disruption caused by a natural disaster, military conflict or pandemic.
  • Specific Salary Thresholds: Most applicants need to earn at least £41,700 a year and at least the going rate for their occupation code. Lower figures apply to jobs on the Immigration Salary List, health and education jobs on national pay scales, care workers, and people first granted Skilled Worker permission before 4 April 2024 who have held it continuously since.
  • English Depends on Your Application Date: A Skilled Worker who applies for settlement before 26 March 2027 has no English requirement at that stage. One who applies on or after 26 March 2027 must show B2 in speaking and listening, unless exempt. Partners and adult children need B1 in speaking and listening before that date and B2 on or after it.
  • The 28-Day Rule: You can submit your ILR application up to 28 days before you officially reach your 5-year anniversary.

Introduction

Indefinite Leave to Remain (ILR) is one of the most important milestones for migrants building their life and career in the UK. It allows you to live, work, and study in the UK without immigration restrictions and can eventually lead to British citizenship.

However, many migrants are confused about when they actually qualify for settlement, especially with ongoing discussions about potential immigration reforms.

Recently, there has been widespread discussion about a proposed “Earned Settlement” reform that could extend the route to settlement from five years to ten years. None of those proposals is in the Immigration Rules, and the requirements below apply until new rules are laid before Parliament and come into force.

For now, the 5-year settlement route remains open for Skilled Worker visa holders and several other qualifying routes.

This blog explains the key ILR requirements for Skilled Worker visa holders, including the five-year qualifying period, absence rules, salary requirements, employer confirmation, and how to calculate your eligibility.

What Is Indefinite Leave to Remain (ILR)?

Indefinite Leave to Remain is the UK immigration status that allows migrants to settle permanently in the UK.

With ILR you can:

  • Live and work in the UK without visa restrictions
  • Access certain public benefits if eligible
  • Travel in and out of the UK more freely
  • Apply for British citizenship after meeting the eligibility criteria

Many Skilled Worker visa holders aim to apply for ILR after completing their qualifying residence period.

The 5-Year ILR Qualifying Period

Most Skilled Worker visa holders can apply for ILR after completing five continuous years of lawful residence in the UK.

You can apply up to 28 days before completing the full five years.

Qualifying visa routes that count towards the 5-year period

Your continuous residence can include time spent on one or more of the following visas:

Qualifying Visa Routes
Skilled Worker or Tier 2 (General)
Health and Care Worker
Global Talent
Innovator Founder
Scale-up Worker
International Sportsperson
Minister of Religion
Representative of an Overseas Business
Previous Tier 1 routes (except Graduate Entrepreneur)

You may also combine time across these routes if you switch visas.

Three limits apply. Your most recent permission must be as a Skilled Worker. Time spent as someone else's dependant does not count towards your own five years. And time on the Graduate, Student, High Potential Individual, Youth Mobility, Visitor and Global Business Mobility routes does not count. Our Indefinite Leave to Remain and Settlement guide sets out the rules for every route.

When Does Your ILR Clock Actually Start?

One of the most common misunderstandings involves the start date of the five-year qualifying period.

Many migrants assume their ILR clock begins when they arrive in the UK.

In most cases, the Home Office calculates your qualifying period from the visa start date shown on your visa or eVisa, not your arrival date.

This means that even if you travelled to the UK later than the visa start date, those days still count towards your five-year qualifying period. They also count as days outside the UK. If your visa started 60 days before you arrived, you have already used 60 of the 180 days allowed in that first 12 months, so count them before you book a long trip in your first year. If you switched into the Skilled Worker route from inside the UK, your period on that route runs from the date the permission was granted.

Absence Rules: The 180-Day Requirement

To qualify for ILR, you must meet the continuous residence requirement.

This means you must not spend more than 180 days outside the UK in any 12-month period during your five-year qualifying period.

However, life happens. Days abroad for a reason listed in the Immigration Rules are left out of the 180-day count. The list includes compelling and compassionate personal circumstances, such as the life-threatening illness of the applicant or the life-threatening illness or death of a close family member, and travel disruption caused by a natural disaster, military conflict or pandemic. The list is closed. Ordinary business travel and parental leave spent abroad are not on it, and you should expect to provide evidence of the reason.

Salary Requirements for ILR

To qualify for Indefinite Leave to Remain as a Skilled Worker, you must still meet the salary rules linked to your visa.

In most cases, you must be paid whichever is higher of the following:

RequirementExplanation
£41,700 per yearThe general salary threshold for settlement
The “going rate” for your occupationEach occupation code has its own salary benchmark

For example, if your salary is £42,000, but the official going rate for your occupation is £45,000, you would not meet the salary requirement.

Because salary rules depend on your occupation code and visa history, many applicants should check their eligibility carefully before applying.

Situations Where Salary Requirements Are Different

Some Skilled Worker visa holders may qualify under different salary thresholds depending on their job or when their visa was first issued.

Healthcare and Education Jobs

If you work in certain healthcare or education roles, the salary rules are based on national pay scales.

You must usually earn whichever is higher of:

RequirementAmount
Minimum salary£25,000 per year
National pay scale rateThe official pay band for your role

Jobs on the Immigration Salary List

If your occupation is on the Immigration Salary List, the threshold may be lower.

You must usually earn whichever is higher of:

Requirement

Amount

Minimum salary£33,400 per year
Standard going rateBased on your occupation code

Workers Sponsored Before 4 April 2024

If you were first granted Skilled Worker permission under the rules in place before 4 April 2024 and have held Skilled Worker permission continuously since, different salary rules apply.

In many cases, you must earn whichever is higher of:

Requirement

Amount

Minimum salary£31,300 per year
Lower going rateBased on your occupation code
Immigration Salary List role£25,000 per year, and the lower going rate

Care Workers and Senior Care Workers

A care worker or senior care worker employed by an eligible employer, such as a provider registered with the Care Quality Commission, must earn at least £25,000 per year and the going rate for the role, which is also £25,000. This applies whatever date you were first sponsored. A figure of £25,000 also applies to some researchers and higher education teaching staff who were sponsored under Tier 2 (General) in specific occupation codes.

International Sportsperson Visa

Applicants under the International Sportsperson or Tier 2 Sportsperson route must normally earn at least:

£35,800 per year

Minister of Religion Visa

Applicants under the T2 Minister of Religion route must be paid at least the same as UK workers doing the same role and meet national minimum wage requirements.

Important Salary Rule

When calculating your salary for settlement:

  • Only income from your sponsored job can be counted
  • If you are paid hourly, earnings can normally be calculated up to 48 hours per week
  • The new entrant and PhD discounts that can apply to a visa application do not apply at settlement

This is an important rule because income from secondary employment or supplementary work usually cannot be counted towards the ILR salary requirement.

Why Salary Checks Are Important Before Applying

Salary calculations are one of the most common reasons ILR applications are refused.

Applicants often assume their salary qualifies, but the Home Office will check:

  • The occupation code going rate
  • The salary threshold rules
  • The hours worked
  • Your sponsor confirmation letter

Because the rules can vary depending on your visa history, checking your eligibility before applying is highly recommended.

Employer Confirmation Letter Requirement

Another important ILR requirement is confirmation from your employer.

Your sponsor must confirm that:

  • You are still required for the job for the foreseeable future
  • You are paid, and will be paid for the foreseeable future, at least the settlement salary
  • The employment is genuine and ongoing

This confirmation normally comes in the form of a letter from your employer or sponsor.

Without this confirmation, your ILR application may be refused.

Your sponsor must also still hold its licence to sponsor Skilled Workers on the day your application is decided. If the licence is revoked before the decision, the application is refused.

English Language and Life in the UK Test

If you apply for settlement as a Skilled Worker before 26 March 2027, there is no English language requirement at the settlement stage. If you apply on or after 26 March 2027, you must show English at level B2 in speaking and listening, unless an exemption applies. What matters is the date you apply, not the date your five years end.

Partners and children aged 18 or over must show B1 in speaking and listening where they apply for settlement before 26 March 2027, and B2 in speaking and listening where they apply on or after that date.

In both cases, most applicants aged 18 to 64 must pass the Life in the UK Test, which is a mandatory requirement for settlement.

Why ILR Applications Can Be Complex

Although the basic rules appear simple, many ILR applications become complicated due to issues such as:

  • Long absences from the UK
  • Changing employers
  • Switching visa categories
  • Incorrect salary calculations
  • Missing employer documentation

We frequently see applicants with extended absences caused by medical issues or COVID travel restrictions.

In some cases these absences can still be justified, but the application must be carefully prepared.

Seeking professional advice can help avoid unnecessary refusals.

When should I start my ILR application if my visa was issued before I travelled?

Calculate your 5-year period from the start date shown on your visa or eVisa, not the date you landed. The days between that start date and your arrival also count as days outside the UK. Because you can apply up to 28 days early, you may be eligible before you have physically been in the UK for five full years. Use our ILR calculator to find your exact date.

Can I combine time spent on a Student visa with my Skilled Worker visa for the 5-year route?

No, time spent on a Student visa does not count toward the 5-year Skilled Worker settlement route. You can only combine time from other "qualifying" routes like Global Talent, Innovator Founder, or T2 Minister of Religion. However, Student visa time can count toward the 10-year Long Residence route.

What happens if my salary is below the £41,700 threshold?

If you do not meet the standard threshold, you may still qualify if your job is on the Immigration Salary List, if you work in a regulated healthcare or education role, or if you were sponsored before 4 April 2024. In these cases, you might qualify at a threshold as low as £25,000 or £31,300 depending on your specific circumstances.

What documentation do I need from my employer for ILR?

You must provide a letter from your current sponsor, dated no more than one month before your application. This letter must explicitly state that you are still required for your job, that your employment is ongoing, and that you are being paid at or above the relevant salary threshold for settlement.

Are medical absences always excused if I exceed 180 days?

No. Absences of more than 180 days in any 12 months are not automatically excused. Only the reasons listed in the Immigration Rules are left out of the count, such as the life-threatening illness of the applicant or a close family member, or travel disruption caused by a natural disaster, military conflict or pandemic, and you should expect to provide evidence.
