Why Do You Need A Robust HR System If You Want To Apply For A Sponsor Licence

According to the Home Office, organisations who are in need of hiring non-British nationals must have a valid Sponsor Licence.  When applying for the Sponsor Licence, apart from the required documents, the organisation is also required to have a robust Human Resources Management system (HRMS) in place to support a sponsor licence application.

Why does the Home Office require a robust HR system for organisations?

The reason why Home Office asks for a robust HR system is that they want to know if you’re able to manage the human resource files properly and if you’re able to carry out the sponsorship duties once you are awarded a Sponsor Licence. Most common sponsorship duties are as under:

  1. Monitoring immigration status 
  2. Maintaining migrant contact details 
  3. Record keeping and recruitment practices
  4. Migrant tracking and monitoring  

Home Office visit

Before Home Office give a decision on your Sponsor Licence application, sometimes they will conduct a site visit to your business.

During the visit, the inspector might ask about how you manage your HR files, are you aware of the Immigration status of your employees, do you have a system to make sure you manage your employees’ files etc. Therefore, it is important to show them you have a robust HR system in place to manage this.

If you fail to show them you have a robust HR system, or fail to prove you have the ability to carry out sponsor duties, your sponsor licence application will likely be refused.

The sponsor licence refusal will result in a 6 -12 months cooling-off period. You can not re-apply again until you pass the cooling off period.

You still need a HR system after your Licence is granted

Every year the Home Office conducts spot-check raids on companies that hold Sponsor Licences. Maybe all of a sudden, they decide to come to your company to check whether the employees with work permits are working normally, whether the company has recorded in accordance with the duties, and whether the human resources management is robust...

If the Home Office finds evidence you are not performing their duties, your sponsor licence might be downgraded to the B level. In more serious cases, your sponsor licences could be suspended or even revoked, meaning the visas of their sponsored workers would be cut.  Therefore, it is important to have a HR system at all time.

However, many HR systems in the market have very general functions, they are not specifically designed for managing migrants.  As a Sponsor Licence holder, you need to follow the Home Office guidelines, to monitor some specific things for your migrant employees.  For example, you need to keep a good record of your employees’ immigration status, how long their visa is valid, do they have the right to work in the UK, how many hours are they allowed to work, when will their passport/BRP expire, and will you be notified etc.
